Leglity of a polygraph test.
There is no law in South Africa prohibiting the use of Polygraph testing to establish the truth. It may also be used in court and in labour related cases and is frequently used by employers and recognized in the CCMA.
No person under the South African Constitution can be forced to undergo a polygraph examination unless otherwise described in his / her employment agreement. The examinations must be voluntarily. He/She has the right to have an interpreter. No discrimination or threats will be allowed.
